Terms of Service
These Terms of Service ("Terms") govern your access to and use of CrispCheckout (the "Service"), operated by CrispCheckout LLC, 30 N Gould St, Sheridan, WY 82801, United States ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service does
CrispCheckout provides software that lets merchants replace the native checkout on their Shopify store with a branded, hosted checkout that processes payments through the merchant's own Whop account and writes completed orders back to Shopify. We are a software provider. We are not a payment processor, bank, or merchant of record, and we never take possession of your customers' funds — payments flow directly through your Whop account at your own Whop processing rate.
2. Accounts
You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. You must be at least 18 years old and authorized to bind the business you represent.
3. Billing
The Service is free to build and preview. To go live you subscribe to a paid plan of $99/month plus a usage fee of 0.5% of the order volume you process through CrispCheckout, billed monthly through Whop. Card-processing fees are your own Whop rate, paid to Whop — not to us. Subscriptions renew automatically until cancelled. Fees are exclusive of taxes, which are your responsibility where applicable. Pricing may change with reasonable notice.
4. Your responsibilities as a merchant
You are solely responsible for your products, your store, your customer relationships, and your own store policies (refunds, shipping, privacy, terms) shown at your checkout. You agree to comply with all applicable laws, the Shopify and Whop terms, card-network rules, and to sell only lawful goods and services. You are responsible for fulfilling orders, handling customer support, and resolving chargebacks and disputes.
5. Acceptable use
You may not use the Service for fraud, money laundering, the sale of prohibited or illegal items, or anything that violates the rules of Shopify, Whop, or applicable payment networks. We may suspend or terminate accounts that we reasonably believe violate these Terms or create risk for us or our partners.
6. Service availability
We work to keep the Service reliable but provide it "as is" and "as available," without warranties of any kind. We do not guarantee uninterrupted or error-free operation.
7. Limitation of liability
To the maximum extent permitted by law, CrispCheckout is not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amounts you paid us in the three months before the claim.
8. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate access for breach of these Terms. On termination your right to use the Service ends; sections that by their nature should survive (billing owed, liability, disclaimers) survive.
9. Changes & governing law
We may update these Terms; material changes will be posted here with a new date. These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws rules. Privacy Policy
This Privacy Policy explains how CrispCheckout handles information when you use the Service.
Information we collect
Account data — your email address and authentication details when you sign up.
Store & configuration data — your store domain, branding, checkout layout, shipping, discount, and integration settings.
Order & checkout data — order totals, items, and the customer details needed to complete a checkout (such as email and shipping address). For this data, the merchant is the data controller and CrispCheckout acts as a processor on the merchant's behalf.
Usage & device data — basic logs, cookies, and analytics needed to run and secure the Service. Merchants may add their own marketing pixels (e.g. Meta, TikTok) to their checkout, which are governed by those providers' policies and the merchant's own privacy notice.
How we use it
To provide and improve the Service, process billing, prevent fraud and abuse, provide support, and comply with legal obligations. We do not sell your personal information, and we do not allow advertisers to pay to influence the Service.
Sub-processors
We rely on trusted providers to operate, including Supabase (database & auth), Whop (payments), Shopify (your storefront & orders), and Vercel (hosting). Sensitive credentials are encrypted at rest.
Retention & your rights
We keep data for as long as your account is active or as needed to provide the Service and meet legal obligations, then delete or anonymize it. Depending on your location you may have rights to access, correct, or delete your personal data — email support@crispcheckout.com and we'll help.
Refund & Cancellation Policy
This policy covers what you pay us for the CrispCheckout software subscription. It does not cover refunds to your own customers — those are governed by your store's refund policy.
Cancelling your plan
You can cancel anytime from your dashboard. When you cancel, your plan stays active until the end of the current billing period and then does not renew. Building and previewing your checkout remains free after you cancel.
Refunds
Monthly subscription fees and the 0.5% usage fee are billed for service already provided and are generally non-refundable, including for partial months. If you believe you were charged in error, contact us within 30 days at support@crispcheckout.com and we'll review it in good faith.
Card-processing fees
Card-processing fees are charged by Whop at your own rate and are separate from CrispCheckout fees; refunds of those are handled through Whop.
